Workplace Know Your Rights

California law provides employees with specific workplace and constitutional rights. Senate Bill 294, known as the Workplace Know Your Rights Act, was enacted in November 2025 and applies statewide.

This notice summarizes key employee rights.

Under California law, employees have the right to:

  • Workers’ compensation benefits for work-related injuries or illnesses, including medical care and partial wage replacement. Information specific to OPUSD is available on the District website.
  • Notice if an immigration agency plans to inspect employee records or request access to non-public areas of the workplace. When advance notice is required by law, the District must post a notice and inform affected employees. This applies to inspections of employment records or requests to enter restricted work areas, not routine daily work activities.
  • Protection from unfair immigration-related practices. It is unlawful to retaliate against, threaten, or take adverse action against an employee for exercising workplace rights.
  • Organize, join, or assist a union, or engage in protected activities with coworkers related to wages, hours, or working conditions. Employees also have the right to choose not to participate in these activities.
  • Constitutional protections when interacting with law enforcement at the workplace, including rights related to searches, questioning, and the right to remain silent.

California law also requires public school districts to follow specific procedures when immigration enforcement activity affects employee records, access to non-public work areas, or school sites. When the District receives notice of such activity and is legally permitted to do so, it must provide notice to affected employees and follow the required posting, documentation, and reporting procedures. These requirements are intended to provide transparency and protect employee rights and do not indicate that any individual employee is under investigation.

Employees also have the right to:

  • Designate an emergency contact by submitting the Emergency Contact Form to Human Resources.
  • Indicate on the form whether the designated contact should be notified if the employee is arrested or detained on the worksite, or during work hours, or while performing job duties, if the District has actual knowledge of the arrest or detention.
  • Update emergency contact information at any time by submitting the form below.
